1. Introduction
This Privacy Policy explains how PowerTechs Inc. (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with PowerTechs Platform, a skills assessment and job matching platform.
PowerTechs Platform provides a game-like skills assessment experience for individuals seeking work opportunities (“Talents”) and a job posting and skills-mapping platform for employers and hiring organizations (“Employers”).

This Privacy Policy applies to our website, platform, Talent assessment experience, Employer dashboard, communications, and related services.
By using the platform, you acknowledge that we process personal information as described in this Privacy Policy.


2. Important Assessment Data Notice
Our assessment does not collect or process video, audio, voice recordings, facial images, facial geometry, fingerprints, retina or iris scans, eye-tracking data, voiceprints, biometric identifiers, or biometric templates.
The assessment is based on information you provide and interaction data generated during the assessment, such as clicks, selections, pauses, timing, task choices, task completion status, and session events.
If we introduce any feature that collects video, audio, voice, facial, eye-tracking, or biometric data, we will update this Privacy Policy and provide any legally required notices and consents before activating that feature.


3. Personal Information We Collect
We may collect the following categories of personal information.

Account Information
We may collect name, email address, username, password or authentication credentials, account type, role, location, communication preferences, and similar account information.

Talent Profile Information
If you are a Talent user, we may collect information you choose to provide, including resume information, work history, education, skills, certifications, portfolio links, professional interests, job preferences, location preferences, availability, compensation preferences, and other career-related information.

Employer Information
If you are an Employer user, we may collect your name, business email address, company name, role or title, company profile information, billing information, job postings, job descriptions, job requirements, hiring criteria, and related account information.

Assessment Interaction Data
When Talent users complete a game-like assessment, we collect interaction data such as clicks, selections, pauses, timing, task choices, task completion status, sequence of actions, session events, and related performance signals.

Skill and Matching Outputs
We may generate skill indicators, inferred skill categories, assessment summaries, job-match suggestions, compatibility indicators, or similar outputs based on Talent profile information, Employer job information, and Assessment Interaction Data.

Device and Usage Information
We may collect IP address, browser type, device type, operating system, approximate location derived from IP address, referring URLs, pages viewed, log data, cookie identifiers, session activity, and security-related events.

Communications
We may collect messages, support requests, feedback, survey responses, accommodation requests, complaints, and other communications with us.

Optional Demographic, Accessibility, or Accommodation Information
Where offered, Talent users may voluntarily provide demographic, accessibility, disability-related, or accommodation-related information. We use this information only for legally permitted purposes such as providing support, considering accommodation requests, improving accessibility, conducting fairness monitoring, or complying with legal obligations.
We do not use optional demographic information to generate individual hiring recommendations.


4. Sources of Personal Information
We collect personal information from:
  • you directly;
  • your use of the platform;
  • Employers that use the platform;
  • service providers and vendors;
  • integrations or third-party services you choose to connect;
  • publicly available or professional sources, if you choose to provide or link them.

5. How We Use Personal Information
We use personal information to:
  • create, maintain, and secure Talent and Employer accounts;
  • provide the skills assessment and job matching platform;
  • operate the game-like assessment experience;
  • generate skill indicators, assessment summaries, and job-match suggestions;
  • help Talent users discover potentially relevant job opportunities;
  • help Employers map job requirements to skills;
  • allow Employers to review Talent information where Talent users apply, opt in, or otherwise authorize sharing;
  • communicate with users;
  • provide customer support;
  • process Employer payments;
  • prevent fraud, cheating, abuse, scraping, unauthorized access, and platform misuse;
  • troubleshoot, test, debug, and improve the platform;
  • conduct analytics, quality assurance, accessibility review, fairness monitoring, and model evaluation;
  • enforce our Terms of Service;
  • comply with legal obligations.
We do not use video, audio, voice, facial, eye-tracking, or biometric data because we do not collect those categories as part of the assessment.
We do not intend platform outputs to be used as the sole basis for hiring, rejection, compensation, promotion, retention, termination, or other employment decisions.


6. Automated Assessment and Matching
Our platform may use automated systems to process Talent profile information, Employer job information, and Assessment Interaction Data. These systems may generate skill indicators, assessment summaries, job-match suggestions, compatibility indicators, or similar outputs.
These outputs are decision-support information only. They are not intended to determine employment eligibility and should not be used as the sole basis for hiring, rejection, compensation, promotion, retention, termination, or other employment decisions.
Employers are responsible for using their own lawful, job-related, non-discriminatory, and human-reviewed hiring process. Employers are also responsible for complying with laws that may apply to employment tests, automated employment decision tools, artificial intelligence tools, consumer reports, reasonable accommodations, and anti-discrimination requirements.
Where required by law, Talent users may request access to certain personal information, request correction of inaccurate information, request deletion, request human review, request an alternative assessment method, or exercise other applicable privacy or employment-related rights.


7. How We Share Personal Information
We may disclose personal information as described below.

Employers
If you are a Talent user, we may share your Talent profile information, selected assessment summaries, skill indicators, match suggestions, application status, and communications with Employers according to your account settings, applications, opt-ins, or other platform workflows.
We do not share raw assessment interaction logs, such as click-by-click or pause-by-pause event records, with Employers unless specifically disclosed, legally required, or necessary to investigate fraud, cheating, security issues, or platform misuse.

Talent Users
If you are an Employer, we may display your company name, job postings, job descriptions, role requirements, and related communications to Talent users.

Service Providers
We may disclose personal information to vendors and service providers that support hosting, security, analytics, customer support, communications, payment processing, assessment operations, infrastructure, and other business functions.

Legal, Safety, and Compliance
We may disclose personal information if we believe it is necessary to comply with law, legal process, government requests, regulatory obligations, security requirements, or to protect rights, safety, property, users, or platform integrity.

Business Transfers
We may disclose personal information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

Professional Advisors
We may disclose personal information to attorneys, auditors, insurers, accountants, consultants, and other professional advisors.


8. Sale, Sharing, and Targeted Advertising
We do not sell Talent assessment results for money.
We do not use Talent assessment interaction data for cross-context behavioral advertising.
We may use cookies, analytics tools, or advertising technologies on our website. Depending on applicable law, some of these activities may be considered “sale,” “sharing,” or “targeted advertising.” Where required, we provide opt-out choices.

9. Cookies and Similar Technologies
We use cookies and similar technologies to operate the platform, remember preferences, secure accounts, understand usage, improve performance, prevent fraud, and support analytics.

10. Data Retention
We retain personal information for as long as reasonably necessary to provide the platform, maintain accounts, support assessment integrity, comply with legal obligations, resolve disputes, enforce agreements, conduct audits, and maintain security.
Unless a longer period is required or permitted by law:
  • Talent account information is retained while the account is active and for up to [X years] after account closure;
  • assessment summaries and skill indicators are retained for up to [X years];
  • raw Assessment Interaction Data is retained for up to [X months / X years];
  • Employer account and billing records are retained for up to [X years];
  • security logs are retained for up to [X months / X years];
  • legal, compliance, dispute, and audit records may be retained longer where necessary.
You may request deletion of personal information as described below, subject to legal and operational exceptions.

11. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These may include access controls, encryption, logging, monitoring, vendor review, security testing, and internal policies.
No system is completely secure, and we cannot guarantee that personal information will be immune from unauthorized access, loss, misuse, or disclosure.


12. Your Privacy Rights
Depending on your state of residence and applicable law, you may have the right to:
  • request access to personal information we hold about you;
  • request deletion of personal information;
  • request correction of inaccurate personal information;
  • request a copy of your personal information;
  • opt out of sale, sharing, targeted advertising, or certain profiling;
  • limit use or disclosure of sensitive personal information;
  • appeal a denial of a privacy request;
  • request information about certain automated decision-making activities;

If you are a California resident, this section provides additional information under California privacy law.
We may collect the following categories of personal information:
  • identifiers;
  • commercial information;
  • internet or electronic network activity information;
  • professional or employment-related information;
  • education information;
  • inferences;
  • sensitive personal information, only where voluntarily provided or necessary for accommodation, account security, or legally permitted purposes.
We collect and use these categories for the purposes described in this Privacy Policy.
We may disclose these categories to service providers, contractors, Employers, professional advisors, legal authorities, or other parties as described in this Privacy Policy.
We do not knowingly sell or share personal information of individuals under 16.
Where required, California residents may request access, deletion, correction, portability, opt-out of sale or sharing, limitation of sensitive personal information, and other rights available under California law.
If we use automated decision-making technology in a manner that gives rise to California access, opt-out, or notice rights, we will provide required notices and rights.


14. Employment Screening and Consumer Reporting Notice
Our platform is designed to provide skills assessment support and job-match suggestions.
Unless we enter into a separate written agreement that expressly states otherwise, we do not intend to provide background checks, credit reports, criminal history reports, education verification, employment verification, reference checks, consumer reports, or investigative consumer reports.
Employers may not use platform outputs as a consumer report, investigative consumer report, background check, or employment screening report unless all legally required notices, authorizations, certifications, dispute procedures, adverse action procedures, and other compliance steps are in place.
If an Employer uses platform outputs for employment purposes in a way that triggers the Fair Credit Reporting Act or similar laws, the Employer is responsible for complying with those laws unless a separate written addendum assigns specific obligations differently.


15. Accessibility, Accommodations, and Alternative Assessment
If a Talent user has a disability, assistive technology need, medical condition, language barrier, technical limitation, or other circumstance that may affect assessment performance, the user may contact us at privacy@powertechs.us.
Where appropriate, we may provide support, an alternative assessment method, additional time, or other reasonable accommodation. Employers are responsible for their own legal obligations regarding reasonable accommodations in hiring.


16. Children
The platform is not intended for children under 18. We do not knowingly collect personal information from children under 13.

17. International Users
The platform is intended primarily for use in the United States. If you access the platform from outside the United States, your information may be processed in the United States or other locations where we or our service providers operate.


18. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law. The “Effective Date” above indicates when this Privacy Policy was last updated.
